8/13/2009 - Espaldon Introduces Designated Beneficiary Act
Addresses Concerns of those For/Against Bill 185
Senator James V. Espaldon introduced legislation today that if passed, would grant residents of Guam the right to designate a loved one to make certain legal and medical decisions on the person’s behalf. The bill is titled the “Designated Beneficiary Agreement Act of 2009” and is co-sponsored by Senators Frank F. Blas, Jr. and Thomas C. Ada.
Having listened and read the numerous testimonies offered during the public hearing for Bill No. 185, Senator Espaldon recognized and acknowledged the arguments made by the opponents and proponents of the issue. A lawyer by profession, Espaldon sought an alternative process to address the needs of all parties concerned. After serious thought and consideration, the Senator introduced the Designated Beneficiary Act of 2009 to address certain rights that are being asked by proponents without affecting the current laws as they pertain to marriage.
The Senator recognizes that this legislation will not fully appease both sides, but he believes this Bill will be a middle-ground solution, and hopes it will preserve the peace and well being of our community.
